Help Please
I am 18 years old and a student. I opened an account at firepay.com to play online poker. I stopped playing and I closed my bank account because I have no money left. A month after they said I made a transaction totaling $2000. They keep calling my parent's home as I currently live in an apartment near my school. I am denying the transactions but they keep threatening me over fraud. "Check-writing fraud". Does someone know what this is?.. They emailed me saying they will

A. Report your default to various national check writer databases to ensure that all future check writing privileges are suspended until this matter is resolved.

B. Send your account to a collection agency which may damage your credit rating.

C. Place your information on a Global Internet Negative Database which will prevent you from conducting business over the Internet in the future.

I have no money to pay an attorney if they plan to sue me nor to pay off these balances that I did not make. What should I do?

Hi-
I've been reading posts here but am not an expert. But I wanted to share something that happened to me over the internet. Here it goes: I was an AOL customer for over 10 years. Since I enrolled online to AOL the payment transaction was electronically taken from my checking account. I switched banks AND upgraded to DSL service with another company. AOL continued to charge me for almost 5 months thereafter for service they did not render and claimed I owed a balance. AOL also never sent me a bill for the balance which I thought was odd, they just sent my account straight to collections. :evil

does anyone know the chances of them suing and if this check writing fraud thing is valid..? what should i do?

another thing is that he keeps asking for my attorney's number.. I keep telling him I don't have one.. he says I have until 12-17.. (i think he meant to find an attorney).. do you think he is for real or is it just threat tactics? I don't have money for an attorney..

Hi Shinn:

Sorry to hear about your situation.

I personally think that online casinos are the biggest scams out there.

Where is this company located? If they are taking online gambling money then I guarantee you they are not in the USA, which is good news for you. You see, internet gambling is illegal in the USA, all of these companies are located offshore.

First of all...

#1. I'm pretty damn sure they are outside the USA which would make it a lot harder for them to do anything.

#2. In order for someone to sue you for writing bad checks they have to have proof (the bad checks). If you did these transactions online then there are no checks!!
Good luck to them proving otherwise.

Also, in order to sue you they would have to do it in the USA, in the county where you live. They would have to be the stupidest people to come to the USA and sue someone over an illegal debt.

#3. I have never heard of a Global Internet Negative Database. It's illegal for any company (in the USA) to share your name and contact info for not paying a bill.

So Shinn, I'd say that they're only trying to scare you into paying, and the worst you're looking at here are a lot of annoying phone calls, at least for a while.

I sure hope you learned your lesson though, stay away from those gambling sites! They're scams!

Thanks alot Alex.. I was looking forward to your response.

No where on their site has an address or where they originated from.. so I did a domain whois.. turns out they are in Canada. Would it be the same as you mentioned in this scenario? Can't they hire a lawyer (which they probably have one based here) from the US to sue me?
and the thing is, they are sort of like a middle man.. they are similar to paypal but only deal with online gambling.

Since online gambling IS illegal in the US, as Alex said, it doesn't matter if they're in Canada, Antarctica or French Frigate Shoals--they'd be dumber than a rock to try suing you over this debt.

Tell these folks to take a long walk off a very short pier in their concrete overcoat.

And don't go near online gambling, or any gambling again, okay?

Lesson learned, I give you my word that I'll never touch gambling again. I'll keep you guys posted on the details so you guys can help me out if they try to pull something... What should I do if they send me a bill, or send it to a collection agency, or anything else besides harrassing me over the phone?

added: Do you think that it makes a difference that FirePay is not directly associated with the actual online gambling even though every single one of its "merchants" are online gambling? Plus I found this on their site:

I just did a quick Google search for FirePay and, in the bottom right corner (pale blue print) it says they are traded on the London Exchange.

They aren't in the US.

I'm pretty sure they have plenty of insurance to cover any losses they may incur.

As for their harassing you over the phone, you might consider checking the caller ID if you have it before answering (don't pick up if you don't know the caller or he's not identified) or let your answering machine screen calls for you. You don't have to answer the phone every time it rings but you can pick up if you hear someone you want to talk to.

If you operate only off a cell phone, it has a messaging feature, too. Let that work for you.

Just don't let them harass you and you can do that by taking control of who you will talk to.

Okay just got another email from them.. looks like he's backing off the sue/credit fraud threats..

The information on Creditinsiders uses the Federal law on credit issues. If this company were in the US you would write them one of the credit repair letters shown on the site and send it via Ceritified Mail Return Receipt Requested.

But, since this company is in London, UK, this doesn't work.

Nothing lost, though. They'd have to come to the US to file a suit, etc. Would not be a smart move.

You did not send any checks because you used a Web site to pay and the money came out of your bank account (which you have since closed). So their claim on the checks is BALONEY.

And they're contacting you via the web? If there is any way of getting some reject on that site so you don't receive it, I'd do it. Otherwise, when you see it, just delete without even reading.

A collection agency? Any one here in the US would be a fool to try collecting on internet gambling and those from outside the US can't do so.

I tried finding information on that claimed "Global Internet Negative Database" and came up empty-handed. Should have found some information if such an entity existed. Sounds like something these creeps just made up.

Should this show up on your credit report (a HIGHLY UNLIKELY situation), then you can dispute it. But, again, since Internet gambling is illegal in the US, they wouldn't dare.

Chill out a bit and don't let these goons scare you with their bluff and bluster.

As soon as I thought everything was behind me, I got a letter from a collection agency "XpressCheX" from the creditor: Firepay. It requests return service within 30 days. What should I do?

Shinn, if you are still checking this....whatever happened? Many people are in the same situation. WIth the new laws and with Neteller executives being charged with money laundering...I really wonder what Firepay can do to outstanding debtors.
