citibank acct. sent to attorneys
I have a citibank acct. that was recently sent to attorneys in my state(Ga). They served me with a summons but it has no court date so, I'm assuming it has not been filed yet. Is there anyway this debt can be sent back to citibank so I can settle with them directly. I called their recovery dept. but they said there was nothing they could do since it has already been sent even though they are the original creditor. I don't want to deal with the attorneys, they were total jerks when I contacted them to try to settle with them. Also, How do I know if I am judgement proof?

Send a validation of debt letter to the attorney's office that "supposedly" has filed a suit. They're just a collection agency and MUST comply with the law under the FDCPA.
Judgement proof is specifically determined by certain circumstances. Do you own a house? Stocks? Are you working? Collecting any benefits such as Social Security, disability, etc. What are your circumstances so I can tell you?

recent college graduate who unfortunately took advantage of one too many credit card offers while in school. Full time job, but no savings, no assets, and 20,000 in students loans. Still living at home with parents
Re: citibank acct. sent to attorneys
Call or visit the court house and verify if this is a real summons.
Find out if Citibank sold the account or if they are just hiring that attorney to do the collection for them.
If they are just hiring them, then you can send the collector aka lawyer a cease and desist letter and they will have to send the account back to Citibank.
If Citi has sold the account, then they have given up all rights to it and you have to deal with the collector/lawyer.
How old is this account? Have you checked the sol on it?
You are NOT judgment proof if you have a job and a paycheck coming in, so take any and all court papers that you get very seriously. But verify that the papers you get are from an actual court and not just a collector "scare tactic".
citibank attorneys
Got in touch with citibank which said I have to deal directly with attorney since they were contracted. I was in touch with attorneys to set up payment arrangement. They asked for the address and phone number for employer. I do not want to give it out, do I have to?

Re: citibank attorneys
Smart move, your not wanting to give the "attornies" the info on your employer. These creeps would call you at work or pull some other shenanigans.
Instead, send the attorney a VOD letter, along with a statement that they are not to call, but are to communicate by US Mail OBNLY (as is your right under the FDCPA). Send this certified, return receipt and keep copies for your records.
The attorney is now a collection agency and subject to the law under the FDCPA. Read the Creditinsiders site to learn as much as possible and keep in touch.
DO NOT give a debt collector any kind of information. And by the way, just because they are "lawyers" doesn't mean they are exempt from the Fair Debt Collection Practices act. Send that debt validation letter!
Good luck!

Citibank
I am also with Citibank. They are hard to deal with and their debt attornies are jerks agreed. They keep my account even though I paid them as agreed. Isn't a violation to not report to the credit bureaus after you pay as agreed on a stip?
