Negative on the attorney. You'd file in small claims court in most states. But don't file too quickly. You can send them an "intent to sue letter" mentioning their violation of the FDCPA and the penalty allowed.

But, we'll cross that bridge when/if we come to it, okay?

Hi,

The next step that you need to take is to report the creditor/collection agency to the FTC. You can find the information to report this violation on the website at www.ftc.gov . Make sure that you have copies of the supporting documentation. The FTC will do the rest.

Sorry. but I missed an important point in your first post. Been a bit busy getting my father's final affairs taken care of so the brain is not totally organized.

You said you'd received some letters from the "friendly dog owner/collection agent"? Have you sent him a validation of debt letter? That's very important! He has to prove you owe the debt and he has the right to collect. You'll find a sample at www.creditinsiders.com/letters. Send it certified, return receipt and modify the sample to fit your situation.

Once he gets that, he can't even attempt to collect until he's validated. I shut up one of the nastys by doing the VOD letters and they've been quiet for over a year now because they can't prove they own the debt.

Try that one right away!

If this is a collection agency trying to collect, then the validation is to prove that the CA has the legal right to collect. If they do, then they have copies of the signed contract and other data that proves their claim to the debt.

Do check Flyingifr's site, too. He's been a regular contributor to this site and has a site of his own with additional valuable information.
